We at the Purple Lining (“the Purple Lining”, “We”, “Our” or “Us”) are committed to creating a safe website and protecting the privacy of Our Users. We pride Ourselves on creating a place where young authors can post their creative content safely. We do not attempt to gather any personal information from children under the age of sixteen (16) years. Please read Our Privacy Policy below in order to fully understand Our approach to user safety and the collection and use of personal information.

​The Purple Lining website https://www.thepurplelining.com/ (the “Website”), Privacy Policy and information collection procedures are intended to comply with the Children’s Online Privacy Protection Act (COPPA).

This Privacy Policy (the “Privacy Policy”) describes the policies and procedures of the Purple Lining for the collection, use, storage, transfer and disclosure of information by Us, through Our Website, which includes its applications, widgets or online services owned or controlled by Us. This policy applies to all Our registered Users, visitors of the Website and any service providers.

​By accepting the Privacy Policy in registration or by visiting and using the Website, you expressly consent to Our collection, use and disclosure of your personal information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to Our Terms of Use. The Purple Lining rests on cloud based web servers hosted by Our third party service provider (currently Wix). Our third party hosts may host your data in servers located in the U.S. or elsewhere. Further, your information may also be stored in any Google forms which you may complete on the Website. However, access to such forms will be restricted to only the authorized personnel of the Purple Lining as described below.

In this Privacy Policy we use these terms:

​Member - the Purple Lining has different types of Members, the term being used to describe a registered user of the Website, whether that person is an an Artist or a Regular Member as defined below;

Artist - a Member who is approved as an Artist on the Website via application. Artist content can be used for cover art or displayed in the Purple Lining gallery.

Regular Member - an individual who signs up for a single general user account. As Regular Members you will be required to confirm your month and year of birth on the website.

Users - People who browse Our Website without becoming Members (i.e. without registering are called “Users” of Our Website.

Content/Articles/Events- User content created or posted on the Website in the prescribed format and user provided metadata associated with them such as descriptions.

Review - A review by the moderating  team of the Purple Lining of a story or article submitted by a Member.

The Purple Lining Ambassadors - A Member elected by the internal team of the Purple Lining for promoting the Website, and helping to enroll more Members to the Website. 

The Purple Lining Moderator - A Member elected by the internal team of the Purple Lining who will review Content posted on the site, targeting all hateful language or inappropriate content. Every Post will be reviewed by at least two (2) the Purple Lining Moderators.

1. Information We Collect​​

In general you can browse the Website without telling Us who you are or revealing any personal information about yourself. However, upon writing content or liking others', you must enter your month and year of birth.. With this confirmation, the Purple Lining takes this as true and holds no accountability for any misinformation you chose to provide. 

​Below you will find clear, understandable information on the data we collect and how we use it. We also provide information on data that you may choose to voluntarily share:

1. Information Collected for You:

   1. Basic Information: All Members are required to provide a display image, username, pronouns, their email, and a biography. your email shall only be visible to other Users if you expressly choose to make it visible to other Users. Other Members can request to contact other Members; however, this will be moderated by the Purple Lining team. If a Member chooses not to connect with the other Member, they can opt out of this connection, and We will not connect the two. Members can make their email accessible on their profile upon registration. Month and year of birth confirmation is required so that we can comply with COPPA guidelines. If a User is less than sixteen (16) years old, we do not register them as  Members, and they will not be allowed onto the site. For Users of sixteen (16) years and above, we allow registrations;

      1. All Members who are 16 (sixteen) years or older and pursuant to such disclosure have been registered as Members, and can post articles, stories, art. If Members are found or reported to be of an age less than 16 years, they will be deregistered and their data will be deleted, and any and all liability of such misrepresentation shall be of such Member;

   2. When signing up to Our Website as a Member, you are required to consent to being above the age of 16 (sixteen) years of age and provide your month and year of birth. If they fail to meet this requirement, Users will not be permitted to use the website. Besides, Members may voluntarily share personal information such as photos, text, art, creative cover designs, or further information. This content may be used in your post content;

   3. Device Identification data including information which may assist Us to identify your device, including your IP Address, login information, browser type and version, your operating system, etc.

   4. Conversations with us: Requests to provide referral to other Members for potential networking, collaboration emails, chats can be aided by  Us on a case-by-case basis. We will reach out to the other Members to ensure their willingness to connect with you.

   5. Other data which we may collect from you during the cOurse of your engagement with Us including:

      1. Preferred location, i.e. the location where you intend to participate in events and collaborations;

      2. Average posts in a period;

      3. Preferred means of using Our Services, viz. whether mobile application or desktop;

      4. your association with us, length of time, number of posts etc. to evaluate you for the potential the Purple Lining Ambassador;

      5. Number of times your posts have been marked as red flagged, due to plagiarism, hate speech, etc.;

      6. Referrals, viz. Number of other Members who you have referred to the Website, promoting the Website; 

      7. Data which may be legally required to be collected from you for the purposes of your authentication, identification or verification.

Most of your personal or other data is provided by you whenever you register or create an account with Us as a Member.

1. Information collected automatically

      1. Data that is collected as soon as you create an account with Our Website (for example, your personal data).

      2. Data that is generated through your other actions when you use Our Website and which is linked to your account on Our Website, e.g. when you surf Our Website to look events, programs, seminars, etc organized in your locality, data regarding all other interactions with Our Website and your communications with us.

   2. When the information is automatically collected by software:

Hence, if on your consent your contact information has been shared with any other Member previously, we will not be able to undo that. 

1. We process your personal data in order to allow you to use Our Website as a Member,

   1. Complying with information requests from third parties based on any statutory information rights they have against Us (e.g. in the event of an intellectual property infringement, product piracy, or other unlawful activity).

   2. Ensuring the information security of Our Website.

   3. Compliance with the COPPA Provisions and other privacy laws,

   4. Retention and storage of your personal data to comply with specific legal retention requirements.

4. Duration of the Retention of your Data 

1. As the Purple Lining deals primarily with creative expressions, including events, articles, cover art, designs etc., we do not typically delete or expire posts or accounts as long as the Member maintains an active account with us. 

2. your data shall be retained by Us after the same has been provided to us. Hence, we shall not delete your personal data even after you have stopped using Our Website for the following reasons:

   1. To enable use of the Website: We shall retain your data to effectively enable you to use Our Website. Further, we shall retain your data for such things as executing the Terms of Use with you, maintaining and improving the performance of Our Website, and keeping Our systems secure. 

   2. Statutory or contractual or other similar obligations: Corresponding storage obligations may arise, for example, from laws or official orders. It may also be necessary to store personal data with regard to pending or future legal disputes.

   3. If you choose to remove content from Our site, you must do so through us. You can do this by emailing us at thepurpleliningcom@gmail.com.

1. We do not ever sell or rent your information. We never use or disclose to anyone the information that we collect for third party concerns, and we never use or disclose the information of the Users for any kind of behavioral targeted advertising.

3. We may share certain aggregated, anonymized information with the third parties in order to assess the Website usage and information pertaining to the ease of navigation. This information does not include or disclose any personally identifiable information.

We share your information with Our officers and employees for the purpose of processing your personal data on your behalf, and it is ensured that these recipients of such information agree to process such information based on Our instructions and in compliance with this Policy and any other appropriate confidentiality and security measures.

1. We take all reasonable and necessary steps to protect your personal data during transmission by using encryption protocols and software; however, no security measures can be 100% foolproof.

2. We use SSL encryption to protect your data against unauthorized access and loss of data.

3. Only members of the Purple Lining team will ever have access to your information, not including the incident of cyber attack on our website.

4. It is important for you to protect yourself against unauthorized access to your password and to your computers, devices and applications. You must be sure to sign off when finished using a shared computer. 

5. your data is safely and securely stored on a third-party database, i.e. WIX, specifically employed by Us for the purpose of secure storage of your personal data. However, access to such forms will be restricted to only the authorized personnel of the Purple Lining as described below.

7. Your Rights as a Data Subject

You, as a data subject, have certain rights to the personal data which has been provided by you to us. We have enlisted the same, hereunder:

1. As a registered user, you may receive an email from us. This could be for the following reasons:

   1. Connect you with a fellow Member

   2. Update you on the statUs of a post

   3. Suggest edits to be made for your posts

   4. Give you information about changes to the website

   5. And other general updates pertaining to the website

   1. You can access the information which has been retained by Us by visiting the “Request to Edit Profile” section on the “Contact Us” page of Our Website which would display information supplied by you to us. Information which you shall find in that section would be: 

      1. Display Name

      2. Pronouns

      3. Biography

      4. Email Address

2. ​You can exercise your rights as a data subject via Our Website per the details contained within the present Policy. The aforementioned exercise of your rights is free of charge.

3. You have the right to ask Us to rectify information that you find inaccurate, or to complete the information that is otherwise incomplete. Do this by filling out the applicable form on Our “Contact Us” page or through emailing Us at thepurpleliningcom@gmail.com.

4. You have the right to ask Us to erase any and all personal data that we have collected and are holding in certain circumstances. Please note that we may not be able to honor all requests for deletion of your personal data since certain information may be required to be retained either to meet the requirements of law or for the purpose of audit or for the purpose of maintaining business continuity. In addition, if you have yourself posted information which is publicly available, we may only be able to honor requests for deleting the same from the site and not from other places where it may have been shared by Users.

5. You may request details of the personal data that we hold about you. You may request a copy of the personal data we hold about you. Where possible, we will provide this information in CSV format or other easily readable machine format. You may request that we erase the personal data we hold about you at any time. We will comply with laws applicable to Us in respect of any data breach.

6. If you believe that we have breached a relevant data protection law and wish to make a complaint, please contact Us using the details below and provide Us with full details of the alleged breach. We will promptly investigate your complaint and respond to you, in writing, setting out the outcome of Our investigation and the steps we will take to deal with your complaint. You also have the right to contact a regulatory body or data protection authority in relation to your complaint.

1. We may change this Policy in order to meet with the changing requirements of the business or law, from time-to-time, per Our sole discretion. Any material changes or updates made to this Policy may be notified via a notice on Our Website or via email to you. Further, the Effective date subsequent to changes shall be indicated at the top section of this Privacy Policy with the title: “Last Updated On.”
